I am agreeing with you over the point that Constitution is a living organism. Uniform Civil Code is the need of the hour. The directions given by the Supreme Court in Sarla Mudgal case are very relevent. Futher, it was clarified by the S.C. in Lily Thomas case.
I also appreciate the ground cover by the judiciary in codyfying the personal laws of the religions in India. Especially, in the context of Muslim Laws the fact is much clear. The role played by judiciary is very important in this aspect. Commendable judgements such as Daniel Latif is worth mentioning.
The true spirit of the constitution needs to be interpreted in the light of the above mentioned judgements. Revitalisation of personal laws is the necessity. Because of the fact that muslim law in India allows polygamy, a husband who intends to contract a bigamous marriage finds conversion to Islam as the easiest way out to enter into another marriage, without dissolving the previous one. This position is very awkward for the wife from the previous marriage. The exploitation of the women is unavoidable.
Ours is a secular and democratic republic. The revitalization of personal laws is a commendable effort from the part of the author. Hope that legislature will soon come with the law in relation to Uniform Civil Code.
