Common Cause, a society headed by H D Shourie has filed a civil writ petition in the Supreme Court of India against Union Ministry of Environment and Forests, Central Pollution Control Board, Delhi Pollution Control Committee, Directorate of Health Services, Government of NCT of Delhi, Maharashtra Pollution Control Board.
It has been prayed that a order be issued directing that there will be no future installation of incinerators for the disposal of medical waste and any other waste by way of burning technology.
It further seeks closure of existing incinerators in various States and recognition and encouragement for the new upcoming technologies for the disposal of the Bio-medical waste and other waste, particularly the technologies, which are non burn technologies.
The petition prays for ban on advertisement and allotment of work to any of the operators under the Bio-Medical Waste Rules who treats the Bio-Medical Waste by incinerators or any burn technology.
If the Court accepts these prayers, the study which United Nations Environment Programme (UNEP) through United Nations Office of Project Services (UNOPS) had contracted to COWI of Denmark and Kadam Environmental Consultants of India for implementation of the project "Feasibility Study and Master Plan for Optimal Waste Treatment and Disposal for the Entire State of Delhi based on Public Private Partnership Solutions" would have to incorporate non-burn technology.
